Instructions to Complete Your Disclosures

Please read these instructions before starting your disclosures. Accurate disclosures help protect you, reduce buyer uncertainty, and keep the contract process smoother.

DUFFY Realty is not legally permitted to complete these forms for you. Please answer carefully and to the best of your knowledge because these disclosures can become part of the legally binding Purchase and Sale Agreement.

You can complete the disclosures electronically through Remine (which will be emailed to you) or print the forms and fill them out by hand.

Seller Property Disclosure

Complete the Seller Property Disclosure only if you have lived in the home and can answer from your own knowledge.

The Seller Property Disclosure is also a confidence-building tool. Buyers are not only evaluating the photos and price; they are deciding whether they trust the condition and history of the home. Clear, complete answers can reduce hesitation and help the buyer understand the care you have put into the property.

  • Be detailed. Attach supporting documentation. If you’ve had work done, include invoices, warranties, permits, and inspection reports. Buyers feel more confident when they see documented maintenance and improvements.
  • If there was an issue, you must provide an explanation. Clearly address:
  • Who made the repairs or maintenance? (Licensed contractor, professional service, etc.)
  • What was done? (Full replacement, partial repair, preventative maintenance, etc.)
  • When was it completed? (Date of service or installation.)
  • Where did the issue occur? (Roof, foundation, HVAC, etc.)
  • Why was the work necessary? (Storm damage, routine maintenance, aging system, etc.)
  • How was it resolved? (New installation, warranty repair, structural reinforcement, etc.)
  • Address major components like the roof and HVAC upfront.
  • If the roof is 15+ years old or the HVAC is 10+ years old, include details on service history, recent evaluations, and professional assessments of remaining life expectancy.
  • If applicable, add in the remarks: “Home Warranty Available” to provide buyers peace of mind regarding coverage for key systems.

This level of detail can support your asking price, reduce buyer hesitation, and help prevent avoidable contract problems.

If you choose to list at the higher end of the recommended range and your home has older systems, be ready to document maintenance, service history, and any professional evaluations. Buyers paying a premium often look closely at roof, HVAC, plumbing, electrical, and insurance-related items.

Latent Defects and Fixtures

This disclosure is to be provided when you are NOT completing the Seller Property Disclosure.

Community Association Disclosure

READ CAREFULLY: HOA DETAILS MUST BE ACCURATE

If your property is in an HOA of any kind, this disclosure is required. Errors or omissions can result in significant financial liability for you as the seller. You are fully responsible for any discrepancies, so verify all information directly with your HOA before completing the form.

VERIFY BEFORE COMPLETING THE COMMUNITY ASSOCIATION SECTION

  • Before filling out this section, contact your HOA to confirm all fees, restrictions, and policies.
  • DUFFY Realty does not have access to your HOA’s fee structure or policies—even if we have sold homes in your neighborhood, HOA requirements change frequently.
  • While we’re happy to provide general guidance, we are legally prohibited from completing this form or advising you on specific answers. This applies to all real estate professionals, not just DUFFY Realty.
  • The entire disclosure matters. Mistakes can create costs, delays, or contract problems.

QUESTIONS TO ASK YOUR HOA:

Important HOA Warnings:

If you enter “0” or leave a field blank when a fee actually exists, you may be responsible for that amount at closing.

HOA dues are not the same as an initiation fee.

A special assessment fee is different and may give a buyer termination rights under the contract.

If you do not know the initiation fee, contact your HOA. Do not guess.

If you cannot reach your HOA, wait to complete that section until you have confirmed the information.

ADDITIONAL COST TO YOU:

  • You will be required to obtain an HOA Letter before closing.
  • This can cost upwards of $400 and must be dated within 30 days of closing.
  • The Closing Attorney may order this letter, so verify with them in advance.

Final Reminder:

Do not assume. Verify anything you are not sure about before submitting your disclosures. DUFFY Realty is not liable for errors made on seller-completed disclosures.

Call your HOA and verify all information before submitting the Community Association Disclosure.

Any materials or elements brought into your home that were constructed or built before 1978 require this disclosure. This includes, but is not limited to:
Fireplace mantels

 ✔ Old barn wood

If you are unsure, err on the side of caution and disclose.

When completing documents online, review carefully before signing. Once signed, the document may close and you may not be able to edit or add information without starting again.
